In order for the Yankees to have acquired Fish via Rule 5 wouldn’t the Royals have had to already “pass” on him? Why do they get a second chance at him instead of the Yankees having to give him back to the Angels?

So a team has the right to claim a player they have already passed on at a later date? If Fish does not stay on the Royals 40 man roster does he then go back on waivers, and if unclaimed, back to the Yankees, or back to the Angels?
