PAC Files Suit Against Nevada Challenging A’s Stadium Funding

A political action committee backed by the Nevada State Education Association’s Strong Public Schools has filed a lawsuit against the state and its governor, Joe Lombardo. The teachers union is seeking to overturn last summer’s law approving $380MM in public funding for the construction of a new park on the Vegas Strip.

Evan Drellich of the Athletic and Tabitha Mueller of the Nevada Independent were among those to cover the development. Bill Shaikin of the Los Angeles Times reported in the middle of January that the union was planning to file a suit. The Nevada Independent provides a full copy of the complaint.

The A’s are not named as a defendant. The suit alleges that the stadium funding law does not comply with the state constitution. Among the plaintiffs’ claims is that the proposal needed to be voted on by a two-thirds supermajority as opposed to a simple majority, which is the state’s constitutional requirement for bills creating or increasing public revenue.

The teachers union has voiced strong opposition to the stadium funding law, arguing that public money would be better served on education. That, of course, is a matter of political opinion. Their legal efforts to block the deal have not succeeded thus far. The union previously sought a referendum to allow voters to directly weigh in on the stadium deal. A judge rejected that proposal in November (link via The Associated Press), which the union has appealed.

There’s nothing to suggest the legal challenge represents a serious threat to the A’s relocation efforts at this point. The organization continues to evaluate options for a temporary home city covering the 2025-27 seasons with their lease at the Oakland Coliseum expiring at the end of this year. The A’s are hopeful of having a home facility constructed in Vegas in time for the ’28 campaign.

          @goose You want to know why the results are so bad? It’s because so many parents stick a phone or tablet in their 4 yr old’s hand instead of reading to them so they themselves can get back to playing candy crush and watching idiots on TikTok and Instagram.

          Then when a kid should be held back because they can’t read or write the same parent refuses to let their child be helped and gets them promoted anyway. As the child ages they fall further and further behind and become a huge distraction in the classroom out of frustration and in each classroom there are at least a half dozen of the same type of kid. Now all those kids who are trying to learn lose out because the teacher is dealing with those kids and their parents who refuse to help their kid out. Everyone loses because of the dumb, lazy parents out there and the cycle continues on and on. Teacher salaries should START at 100k because not only are they educators, they’re now therapists, social workers, parent substitutes, healthcare workers and work in an environment that is no longer safe.

        They don’t have a supermajority cause most districts outside of the Vegas area voted against a project that takes their tax dollars and ships them to Vegas construction companies and a California billionaire. The more rural counties cited overcrowded classrooms, homelessness, and inadequate child care services as areas that needed more funding, and instead their tax dollars are shipped to Vegas for the stadium.

          It’s what they teach and unqualified teachers pretty sure many are against teacher’s and their union.

          Can give examples. 1 of my parents taught and was principal of school(s) between elemantary and HS levels. 45y ago since that person retired, but complaints i remember then was lack of newer teachers being ready to teach and piles of regulations from the state and national levels more trouble than any good they could do and can be pretty sure this 45y later piles of useless programs keep flowing, so no self guide to teaching and instead adhereing to rubbish handed down from those who sometimes have never set foot in a classroom to teach.

          I’m and have been against any increases in teacher salary improvement for years, until the unions and those handing out not at all thought at very well rules and how to teach, despite a grand niece being in her 2nd yr teaching, I blame pretty much the system as how it as (d)evolved over the years.

          So keep the salaries lower and they’ll attract more qualified teachers?

          Alternatively, the same bureaucrats that churned out those endless regulations and failed programs often capture over half of the education budget, then need more pointless programs and grotesquely overpriced renovation projects that justify their existence. Vote on more stringent rules directing budgets to the classrooms and things will immediately improve.

          Yes, they will be, and one of the first results will be a dramatic rise in salaries. Teachers give up some salary for job security.

          Not at all saying that it’s better the way it is, just that everyone should think through the consequences before dismantling the system.

Leave teaching to people who know how to teach. How much real world experience is needed to teach 5th graders basic math, English and the names of all 50 states?

        The state of Nevada has a limited amount of tax dollars. If they give it to Fisher, that is money that cannot be spent on Nevada schools which rank near the bottom in the nation. They are saying don’t take that away from schools to give away to a billionaire for his stadium.

          The idea is the revenue provided by the stadium investment, the entertainment dollars spent, the jobs created, will create more tax revenue in the long term. It hasn’t worked everywhere, but Detroit’s whole downtown has been invigorated by this type of deal. I do doubt Las Vegas needs the same.

          Oakland proved they are a great sports town.

          MLB and Commisioners Office SABOTAGED numerous viable stadium deals that were much better that the Las Vegas plan.

          And, when the A’s had excellent Ownership that did not constantly fire sale their players everytime they reached a certain level of arbitration and were “playoffs competitive”,
          the Oakland A’s even sold out their home field and set attendance records hosting some playoffs games.

          A’s are owned by a John Fischer who is much worse than former Dodgers Owner Frank McCourt.

          Commissioner’s Office could have solved the A’s stadium situation 10-20 years ago.

          A billionaire wants a poor city to fund his stadium while he milks the fans dry and puts nothing back into his team. Oakland is the one with the raw deal on their end. He should have been forced to sell for what he’s done with that team. Too bad Joe Lacob couldn’t convince him to give up the team. He will never give up his cash cow so long as the league continues to let him get away with it.

          Try Bill Gates, Paul Allen and the McCaw Cable and technology Firm.
          Jackson’s Ownership Group has the cash and credit to build hundreds of new Major League stadiums.
          However, he was passed over in favor of one of the White fraternity brothers of former Commissioner Bud Selig?!

        I’m not an A’s fan. I think it is a good location. Same division, same time zone as two other teams. A stadium on the south side would open up San Antonio, along with other towns like Bastrop, New Braunfels, San Marcos markets. Any homestand against the Rangers or Astros would be sellouts.

    All of a sudden there are thousand upon thousand of “A’s fans.” They haven’t attended games there for years, but now that they are looking to move the team out of the ghetto, people want to cry about it. The team moving to Nevada is much better for the sport.

          Because the ownership has been horrible for the last 20 years. They drew over 2 million in 2014, then ownership dismantled the team by trading Cespedes and Donaldson away. By 2016 they were down to 1.2 million.

          Also yes the coliseum isn’t a great venue, but John Fisher received revenue sharing because of the ballpark. If he built a new ballpark he wouldn’t have received it anymore.

        Only people trying to make Oakland not seem like a giant cesspool would say that. It’s a dump and that team is an excellent candidate to relocate. Next should be the Marlins and the Rays since they both average less than 10k fans. If a city won’t support a team, it should relocate. Nashville and Charlotte would be great options.

        Unfortunately, staying in Oakland means that the team will continue to be trash under Fisher’s ownership. Unless Fisher can be forced to sell, relocating is still the best option.

        I don’t think things will be much better in a smaller market with a ridiculously small 30,000 seat stadium and Fisher still as owner, but at the very least it will get them out of the rundown Colosseum and into a new stadium.

      How is them moving to Vegas better for the sport? A team relying on opposing fans to make ends meet is kind of gross, this is mutually exclusive to the A’s being the team, almost any team besides the Dodgers will rely on opponents for support in LV.

      A postage stamp dome stadium on the strip isn’t good for the sport either, they’ll be a sideshow.

      Staying in the bay area where there is already fan support, history and a much larger (and wealthier) population is the best answer, even if it isn’t in Oakland proper.

    People here in Nevada don’t want the A’s and I don’t see it as political as much as economics. We don’t need more summer attractions, it’s the winter that is slow for Vegas. The infrastructure is struggling to upgrade fast enough for the current stadiums and they want to add another right in the worst traffic area. Locals in Vegas aren’t happy about a cheapskate owner taking public funds while making traffic worse

      My family living near Vegas is extremely excited for them to move. They are big Raiders and Knights fans now. Stadium projects commonly have public funding as it helps court a team which generates a lot of tax revenue and job creation.

        All of the taxes for the stadium are being used to pay for the stadium, there is no new tax revenue. If anything a 9 acre area of the strip that was contributing taxes won’t be anymore.

          There will be plenty of taxes to collect on, it’ll just take years to recoup and surpass the initial investment. Wasn’t part of the deal a tax district so they could collect taxes on ticket sales? If the A’s can somehow put a winning team on the field in the next decade they could the city/county/state will benefit long term. The Knights are pulling in good attendance, for the NHL, as an expansion team in less than a decade. The Raiders improved, but not enough to draw larger attendance, they’re still bottom 3 in the league. This will be the issue with the A’s. They already have abysmal attendance and even when winning they don’t see sustained attendance. Will a new fan base be created in Nevada? I doubt it, but a stadium isn’t just limited to one sports team.

          Ballparks never pay for themselves. They just transfer tax dollars from one area of a city or region to the ballpark district.

          The people that live in the Las Vegas area won’t magically get a long-term increase in income just because the ballpark was built there and the money they spend in the ballpark district is money they wont be able to spend elsewhere in town.

          Ticket sales for regularly scheduled MLB, NFL, NHL and NBA sporting events, not one offs like the Super Bowl or World Series, bring in tiny percentages of out of state visitors. 3% is at the top of the charts. The Raiders are not only at or near the bottom of the NFL in total attendance and percentage of capacity attendance, but they are also at the bottom of the NFL in percentage of out of state ticket sales.

          Typically, the taxes paid in the ballpark district pay only for the ballpark, and not go into the general fund to help the community as a whole. If I am reading the bill in Nevada, that would be the case there also.

        It is a total fallacy to say that a new stadium will increase jobs or tax revenue. They never do. They just transfer it from another area of the community to the area around the ballpark.

        Casinos do not benefit from the A’s being there. They want you to stay IN their casino spending your money, not spending your limited money at a ballpark.

        Casinos cannot help the A’s. Its literally against Nevada law for them to buy sponsorships, advertising, luxury boxes, or even tickets to give away for sports teams. Why? They take betting action on those teams.

          Raiders were at the bottom before move, but have actually increased their attendance slightly post move compared to the previous decade in Oakland. The A’s will likely see something similar, a tiny increase if that, but their attendance ceiling isn’t very high. They’ll likely see an increase in their estimated value as well like the raiders. The raiders saw a significant boost in evaluation after the move.

          Having these teams and stadiums vs not having them will end up being a net benefit over time financially. Over the last few years there’s already been a significant amount of out of town travelers into the city attributed to sporting events. These people don’t just come to a game and leave, they rent rooms, gamble and make purchases.

    Long story short.

    The State is compelling the county to issue the bonds. If the A’s default the county has to raise property taxes to make the payments. Any legislation that would raise taxes in Nevada needs a 2/3 vote. SB1 received a simple majority.

    Further, the state would not be able to assume the debt because the state constitution clearly prohibits it.

    What’s wild, a republican legislator during the special session even brought this up and the attorney present pretty much said “Don’t worry about that”.

      There are many people that don’t pay taxes that are regular citizens born in the United States. For one reason or another they can’t work and are claimed as dependents. Why should they not get a voice?

      It’s like saying people that pay more in total taxes should have a greater say when their percentage is significantly less than poor people.

    I can’t be upset if it brings more support/money/etc. to the education system even if it does seem very agenda based for that teachers union. At the same time, having a local professional baseball team can also be good for kids, probably nowhere near as important as a properly funded education but certainly could be beneficial. I think the take away really is, government (both State and Federal) really need to do a better job supporting the education system. And if all the lawsuit does is shine a light on that then I say its probably worth it.

      Im not arguing for stadium subsidies by any stretch. But I’m not advocating for throwing more cash into this without results. The path to fixing education in America requires a lot more than simply throwing cash at the same broken system.

          You are right that in the most current data available that Nevada did not graduate 51%. They graduated 81.7% which is 47th in the nation, not dead last. Two states did not provide information, Oklahoma and New Mexico, so that might move Nevada up from 47th to 45th.

          The bottom line is that their graduation rates are in line with their spending per student and ranking on k-12 education.

        Nevada is actually right around the average. Slightly above. I’m not sure why you cited some link with data from before 2008 (and obviously laughable data) presented. Exactly how out of touch with reality do you have to be to conclude that only 50% of HS students graduate in any state?

        Simply spending Money does not fix the problem unfortunately. Unfortunate and sad that the system needs a complete overhaul.

    The PAC will win this lawsuit.

    The funding violates the constitution of Nevada in several ways.

    First of which is that because the state is compelling the county to issue the bonds, when those bonds fall into default the state would be liable. That unconstitutional in Nevada.

    2nd, If SB1 had been written in such a way that the responsibility remained on the county then the county’s only way to repay the bond would be to raise taxes, which requires a 2/3 vote, not the simple majority that SB1 received.

    At the very least this will throw it back to the legislature in order to secure a 2/3 supermajority and the Nevada legislature does not meet again until 2025.

    I believe that John Fisher is completely and thoroughly F’d. He burnt his bridges in Oakland, will be homeless after 2024, and will not get the funding he needs in Las Vegas.

      The baseball fans in Vegas are starting to turn on the A’s. I think they should consider Utah, we will wait for an expansion team.
      There are too many red flags with this deal. The A’s are like your college friend that just couldn’t close the deal..

        The A’s should go back to the SF Bay Area.

        MLB Ownership should force a Sale of the A’s to Well Funded, local Ownership Group that is required to keep the A’s in the SF Bay Area
        and that promises to build a New Stadium in Oakland/SF Bay Area
        WITH THE FULL COOPERATION OF THE MLB COMMISSIONER AND OWNERS.

        MLB has precedents for this.
        Didn’t MLB force the Sale of the Astros before their current run?
        And, the Texas Rangers?\
        I am sure there are more examples.
        It would not be a new thing to.

        The holdup on the Howard Terminal/SF Bay Stadium in Oakland
        APPEARED TO BE A’S OWNER JOHN FISCHER COULD NOT COME UP WITH HIS FINANCING DEAL?!
        If Fischer does not have the money to proceed on the deal.
        then pivot to one of the many other billionaires in the SF Bay Area who have expressed interest in buying the A’s/

        I don’t see those smaller states as having the economy, fan base, tv market, tv revenues to support a MLB franchise.

    In a raw comparison of how States treat their citizens, metropolitan Detroit has three Level I trauma centers (top end Emergency Room services), four if you add nearby U of Michigan.
    There is only one for the entire state of Nevada.
