A Nevada judge has dismissed a legal challenge that was attempting to overturn a law that approved $380MM in public funding, per reporting from Tabitha Mueller and Howard Stutz of The Nevada Independent.
Back in February, it was reported that a political action committee backed by the Nevada State Education Association’s Strong Public Schools had filed suit against the state of Nevada and governor Joe Lombardo.
The suit was attempting to stop the stadium funding on the grounds that the law didn’t comply with the state constitution. One of their claims was that the proposal needed to be voted on by a two-thirds majority as opposed to a simple majority, as is the state’s constitutional requirement for bills creating or increasing public revenue.
Carson City District Court Judge Kristin Luis didn’t weigh in on those accusations. Rather, she dismissed the suit today on the grounds that the plaintiffs lacked standing and didn’t meet the standard of a “public importance exemption,” meaning that she therefore couldn’t make a “determination on the merit of the claims.”
The A’s are planning to build a new stadium on the Las Vegas strip, a project which has a price tag of roughly $1.5 billion, with the $380MM government funding being a notable chunk of that. Reporting from Mick Akers of the Las Vegas Review-Journal in July indicating that the club is planning to make up the difference through various means. That includes $300MM in debt refinancing and $850MM in equity from the family of team owner John Fisher. Fisher’s parents Doris and Don Fisher founded The Gap, the clothing chain. In December of 2020, Forbes estimated the family’s net worth at $8.9 billion. Per today’s report from the Independent, the public funding won’t be released until the private financing conditions are met, among other requirements.
The Las Vegas stadium isn’t expected to be ready until the 2028 season but the club’s lease at the Coliseum in Oakland runs out after 2024. The A’s are planning to play in Sacramento’s Sutter Health Park for the next three years, sharing it with the Sacramento River Cats, the Triple-A affiliate of the Giants. Susan Slusser of the San Francisco Chronicle published a story today wherein multiple people expressed their concerns about the Sacramento plan. The various fears include the artificial turf, the hitter-friendly nature of the park and the general logistics.

Just because something is appealed doesn’t mean the appeal will be accepted. The Supreme Court could well decide there isn’t enough merit to hear the appeal.
In any case, the team will move ahead with a ruling under their belt and a high degree of certainty.

I’m sure if a school department itself or the state’s education department was bringing suit it would be received differently than a political action committee representing the schools. A lot times there are multiple PACs claiming to support and represent the will and best interest of things with various different priorities and interests. Sometimes they’re politically aligned and at odds with local leanings,which could be the issue here. Disclaimer: I know absolutely nothing about the specifics of this particular set of issues, I just know a tiny bit about PACs, their function and how they’re perceived. I’m sure plenty of people know more than me.

As a Las Vegas local, I don’t know that I’d agree that Las Vegas is very well run. However, Unincorporated Clark County (which is much larger and more populous than the City), where the ballpark will actually be located, is quite well run.

Sure, when I lived there for 9 hellish years, I went to the strip when family/friends visited or when work required me to but that was it. No one in my family, none of my friends, ever visited the Nevada equivalent of Mordor.
There is a reason Casinos like the various Station Casinos, the Orleans AZ Charlies, etc exist….for the locals. Most locals would rather take a flight in a helicopter with ejector seats than go to the Strip.

Why is it so bad? Traffic, tourists who believe roads are just big sidewalks etc. For most locals the Strip is as much fun as a week in the Sahara without water.
Also have to consider that most games are night games. LV life blood is gambling not only in Casinos but bars (and even grocery and convenience stores). The largest “floor staff” in casinos/bars work nights and that eliminates a good chunk of potential local fan base from attending.
The majority of residents are transplants. I can’t speak for all of them but when I moved west my loyalty to the Phillies went with me. If I was still in LV I could see going to a game if my Phillies were playing but it would still be rare.
I don’t see attendance being much higher than it is in Oakland after the novelty wears off.

Courts don’t like taxpayer lawsuits about the budget because they aren’t in a position to rewrite the budget. I read the decision in this case though, and I thought the teachers had standing and the court was wrong. Nevada has a “public importance exemption” to standing, and I think this case definitely should have qualified.

Irrelevant overly generalized arguments aside, rural counties in Nevada were upset when the governor told them there was no more money to help them deal with overcrowded public schools and the fentanyl crisis, then suddenly found the funds for building an expensive stadium. I would venture to say that if the owner spent money on halfway decent free agents and locked up guys like Chapman and Olson that the fans would show up for a team that would have a shot at the playoffs.
Before you go saying ‘where are the Rays fans’, the issue is the stadium location. If it were in Orlando or any city that didn’t have half of the 100 mile radius from the stadium in an ocean, they would draw. There is no “general outcry.” There are a handful of Oakland residents who were also baseball fans. Athletics fans didn’t support the team, even when the team was winning and spending. Clear back 20 years now attendance has been lousy. The team hasn’t been viable for 30 years at that location. Keeping MLB in Oakland hasn’t been a priority for the residents of the Bay Area. Just how it is.
Many baseball fans like the idea of being able to make a trip out of Vegas (I couldn’t care less) while watching their team play there, especially in a new stadium with new experiences.
